This is a writ of error to the circuit court of the District of Columbia, for the county of Washington.

The original suit was an action of covenant, brought by Linthicum against Lutz, upon certain articles of agreement, made between Lutz on the one part, and Linthicum on the other part, on the 22d of October 1828. The declaration, after reciting that Lutz, by these articles, leased certain premises in-Georgetown to Linthicum for five years, from the 3d day of May then next ertsuing, and a covenant on the part of Linthicum to pay therefor an annual rent of two hundred and fiflv dollars, the…
