Affirming.
At about 10 a. m. on December 15, 1933, the appellant and defendant below, Ed Cole, shot and killed his uncle, Dexter Cole, in a private country road passing in front of the residence of Nathan Johnson, who resided on Cole’s branch of Stinking creek in Knox county. He was later indicted, charged with murder, and at his trial he was convicted of voluntary manslaughter and punished by confinement in the penitentiary for ten years.
