Affirming.

This is a second appeal. Bowman v. Commonwealth, 276 Ky. 745, 125 S. W. (2d) 213.

The appellant, Hack Bowman, was again convicted and sentenced to life imprisonment for the murder of' Winfred Slone on the night of April 1, 1938. Slone was an innocent bystander. A number of young men had gathered in the combined saloon, store and filling station of Tom Shoemaker about five miles from Beattyville. Some of them had been drinking before they arrived. Because of their misconduct Shoemaker closed np about ten o’clock. A fight on the outside…
