BRIGHT, Circuit Judge.
Andrew Jackson, the warden of a Michigan state correctional institution, appeals a federal district court’s conditional grant of habeas corpus to prisoner Dashawn Lyons1 on the ground of ineffective assistance of counsel. Lyons is currently serv*591ing a life sentence without parole after pleading guilty to first degree murder.
