I. PROCEDURAL HISTORY

The plaintiff, James C. Fleming (“Fleming”), submitted a complaint of race discrimination and retaliation on January 30, 1991 with the Equal Employment Opportunity Commission (“EEOC”). The EEOC issued a Notice-of-Right-to-Sue Letter on January 9, 1992. On June 19, 1992, Fleming submitted a complaint and petition to proceed in forma pauperis.
