This case is before the court on cross-motions for partial summary judgment addressed to four claims, the determination of which is intended by the parties to guide them to settlement of numerous other similar claims. Defendant also moved to strike two affidavits offered by plaintiff in support of its claims. The case was originally assigned to Judge John L. Napier, who has since resigned from the bench.
