This is a suit for damages for personal injuries inflicted upon the plaintiff by a passenger train of the Texas & Pacific Railway Company while he- was employed with a construction gang of the Mack-ay Telegraph Cable Company. He prayed for judgment against both companies in solido for $20,000. The trial was had in the district court without a jury, and resulted in a judgment in favor of the plaintiff for $4,-000 against the railway company and in favor of the railway company for the same amount against the telegraph company on a contract of warranty. The defendants prosecute this appeal.
