This , suit was' commenced in the district court of' Sequoyah county, Oklahoma, on the 13th day of November, 1916, by petition being filed by the plaintiff, Charles Tootle, against W. W. Payne, Iva Payne, and Jess W. Watts, defendants, to recover the possession of the N. E. y± of the S. W. % and lot 6 of section 18, Twp. 10 N., R. 24 B., in Sequoyah county, Oklahoma, containing 78.86 acres. Also asked for the recovery of damages in the sum of $1,200 for the unlawful use and occupancy of said land by said .defendants.
