Appeal from a judgment of the County Court of Hamilton County (Feldstein, J.), rendered October 30, 1998, convicting defendant upon his plea of guilty of the crime of burglary in the second degree.

In satisfaction of an indictment charging multiple counts of burglary and petit larceny, defendant entered a plea of guilty to one count of burglary in the second degree with the understanding that he would be sentenced as a second felony offender to a determinate prison term of five years.
