PRICE, Chief Justice.
This is an action in trespass to try title instituted in the District Court of Rusk County, Texas, by defendant in error, L. M. Shipp, against plaintiffs in error, Eugene Kennedy and Burnett Price, and against Maxey Wilson, W. L. Derden Estate and Will Thompson, defendants in error, and some- one hundred and thirty other defendants. The subj ect matter involved is a one-eighth royalty interest in two tracts of land in Rusk County containing an aggregate of something over 140 acres.
