The matter in controversy herein is the seven-eighths leasehold interest or working interest covering and affecting six-sevenths of the oil, gas and other minerals in a tract of land containing 2.59 acres in the J. B. Cadena league in Rusk County. Plaintiff in error Sun Oil Company claims this interest under an oil and gas lease executed to it as leasee by defendant in error Malinda Schuyler, joined by her son, Horace Schuyler, on July 21, 1930, while defendants in error H.
