OPINION

MILLER, Judge.

This case is before the court after argument on the parties’ cross-motions for partial summary judgment with respect to Count I of plaintiffs complaint and defendant’s motion for partial summary judgment with respect to Count IV. The effective date of the contract in question, January 1,1990, preceded the date of execution, September 3, 1991. Count I puts in issue whether Federal Acquisition Regulation (“FAR”) cost principles in effect on the contract’s effective date or those in effect on the date of execution govern the contract.
