Haikbii, J.:

The appellant, Nicholas Stutsman, was indicted by the grand jury of Pottawatomie county upon the charge that he had murdered one Aaron Haning, in said county, on the 2d day of July, 1896. The cause was removed to Oklahoma county, on change of venue upon application of the appellant, where he was tried and convicted for murder, and his punishment fixed by the jury at imprisonment at hard labor for life. Motions for new trial and in arrest of judgment were made and overruled. Judgment was rendered on the verdict of the jury, from which judgment the defendant…
