This appeal focuses on the liability of defendant Surety Company of the Pacific (hereafter Surety) for attorney’s fees awarded plaintiff in her action against defendant Arnold R. Thomas (hereafter Thomas).

On June 8, 1971, Surety issued its “Contractor’s Bond” to Thomas pursuant to the provisions of section 7071.5 et seq. of the Business and Professions Code.1 On June 14, 1971, Surety issued a like bond in favor *Supp. 26of defendant Lee C.
