Appeal by J ames D. Ryan from a judgment confirming an award of damages made by the council of the city of St. Paul in a proceeding to condemn land for a street improvement.

Ryan is the owner of lot 15 and part of lot 6 in auditor’s subdivision No. 18, city of St. Paul. The city undertook to condemn his' property and other land for what is known in general terms as the Third street improvement. The proceeding was conducted under the home rule charter of the city.
