Jose Valerio (“Plaintiff’ or “Valerio”) brings this wage and hour action, individually and on behalf of other persons similarly situated, against Defendants RNC Industries, LLC (“RNC”) and Richard Tonyes (“Tonyes”), in both his individual and professional capacities (collectively, “Defendants”), pursuant to the Fair Labor Standards Act (“FLSA”), 29 U.S.C. §§ 201 et seq., the New York Labor Law (“NYLL”) §§ 160, 195, 652(1) and 12 New York Codes, Rules and Regulations (“NYCRR”) § 142.
