Tried by general court-martial, the accused was found guilty of rape, in violation of Uniform Code of Military Justice, Article 120, 10 USC § 920, and burglary with intent to commit rape, in violation of Code, supra, Article 129, 10 USC § 929. He was sentenced to dishonorable discharge, forfeiture of all pay and allowances, confinement at hard labor for five years, and reduction to the grade of fireman recruit.
