Plaintiffs, Save the Valley, Inc. (STV), Thomas Breitweiser and L. Jae Breitweiser (the Breitweisers), filed for injunctive relief on January 20, 1999 against Defendants, the United States Environmental Protection Agency (EPA) and EPA officials, Carol Browner and David Ullrich (individually and in their official capacities), under the citizen suit provision of the Clean Water Act (CWA) 1 , 33 U.S.C. § 1365(a), and the Federal Mandamus Statute, 28 U.S.C. § 1361.
