This action was instituted in the court of common pleas, division No. 1, of Oklahoma county, wherein Wallace Campbell was plaintiff and G. G. Peery was defendant. The parties will be referred to as they appeared in the trial court.

The plaintiff in his petition sought to recover the sum of $670.20, including principal, interest, and costs, upon a certain promissory note alleged to have been executed by the defendant, and sought to foreclose a chattel mortgage upon an automobile, which said chattel mortgage was alleged to have been executed by the defendant as security for said note.
