OPINION AND ORDER

VAN ANTWERPEN, District Judge.

On August 6, 1993, plaintiffs, John and Linda Callahan, filed this action, individually and on behalf of their son Michael, alleging violations of 42 U.S.C. § 1983 (“§ 1983”) and various state law tort claims 1 against all defendants. The gravamen of their charges is that they were temporarily wrongly deprived of custody of Michael because of unsubstantiated allegations of child abuse.
