Plaintiff Aqueel Ahmed seeks to compel adjudication of his application for adjustment of immigration status from that of asylee to lawful permanent resident. Defendants, all government officials sued in their official capacities, move to dismiss Ahmed’s complaint for lack of subject matter jurisdiction under Federal Rule of Civil Procedure 12(b)(1) and failure to state a claim upon which relief can be granted under Federal Rule of Civil Procedure 12(b)(6).
