The controversy involved on this appeal relates to a certain promissory note executed and delivered by the plaintiff John Noonan to Tappen State Bank. The note is in the sum of $1675, bears date December 26, 1928, and is payable December 1, 1929 with interest at the rate of 9 per cent per annum.
