Defendant and John Picou were indicted for stealing, on April 28, 1928, four head of cattle, the property of Browder & Browder. Defendant was tried alone, found guilty, and sentenced to the penitentiary. His appeal presents a number of bills of exception for consideration.

The first bill presented is one taken to the • overruling of a motion for a continuance. It appears that the bill of indictment was returned on May 7, 1928; that defendant received notice of the return on the following day; that he was arraigned on May 11, 1928; and that, on the same day, his case was fixed for trial for May…
