This is a state’s appeal challenging a pretrial order suppressing statements that defendant made during a custodial interview. The issue presented to this court is whether, during that interview, the police violated defendant’s right against self-incrimination and his derivative right to counsel under Article I, section 12, of the Oregon Constitution. For the reasons that follow, we hold that the police violated defendant’s state constitutional right against self-incrimination and the right to counsel. We therefore affirm the trial court’s suppression order.
