The Appellant, Eouis Gordon McFadden, was convicted of manslaughter on June 7, 1966, by Judge Joseph R. Byrnes, sitting without a jury, in the Criminal Court of Baltimore, and sentenced to ten years in the Maryland Penitentiary.
The record shows that on February 23, 1966, Katharyn Garrison was pronounced dead on arrival at Sinai Hospital. She was two and a half years old, two feet ten inches tall, weighed twenty five pounds and wore a cast on her right leg because of a congenital bone disease.
