Kinetic Structures Corp. v. United States
United States Court of Claims
1Opinion of the Court
OPINION
YOCK, Judge:
This case comes before the Court on plaintiff’s complaint for declaratory or in-junctive relief plus bid preparation costs in two separate contract actions, and defendant’s motion to dismiss for lack of subject matter jurisdiction.
Because this Court lacks jurisdiction over post-award complaints for bid protest equitable relief, the defendant’s motion to dismiss will be granted as to plaintiff’s first cause of action in its first amended complaint. The Court retains jurisdiction over *344the plaintiff’s second and third causes of action contained therein as hereafter set forth.
