The plaintiff, Paul M. Mellinger, administrator of the estate of Christopher P. Mellinger, appeals from a summary dismissal of his claims under 42 U.S.C. § 1983 (1982), and for intentional infliction of emotional distress brought against the town of West Springfield (town) and a number of unidentified West Springfield police officers. A judge in the Superior Court ruled that the claims are barred by the statute of limitations and by the plaintiff’s failure to follow the procedural requirements of the Massachusetts Tort Claims Act.
