The above styled civil rights action is referred to the undersigned for trial pursuant to 28 U.S.C. § 636(c). (Docket Entry # 27). Pending before this court is a motion' for summary judgment (Docket Entry #29) filed by defendants Paul Tibbetts (“Tib-betts”) and the Town of Plymouth (“the town”) (collectively: “defendants”).
