In this pro se action under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552, plaintiff challenges the response of the Department of Justice’s Executive Office for United States Attorneys (“EOU-SA”) to his request for records concerning a third-party individual. Defendant moves to dismiss pursuant to Rule 12(b)(1) and (b)(6) of the Federal Rules of Civil Procedure or for summary judgment pursuant to Rule 56 [Dkt. No. 8].
