This is a slip and fall action. Initially, the trial court granted summary judgment in favor of the defendant restaurant, Cheung Kong Trading, Inc. d/b/a Grand Buffet & Grill (“Grand Buffet”), on the ground that plaintiff Barbara Warrick-Sims had failed to provide evidence as to the cause of her slip and fall. Plaintiff then moved for reconsideration and to allow the late filing of an affidavit that provided direct evidence that her fall had been caused by ice cream on the floor.
