MONTEITH, Chief Justice.

This is an appeal in a workmen’s compensation case brought by appellee, W. E. Wagner, to set aside an award of the Industrial Accident Board in favor of appellant, Employers Reinsurance Corporation, and to recover compensation for permanent partial incapacity alleged to have been the result of an injury sustained by him on June 30, 1950, in the course of his employment with the Houston refinery of Shell Oil Company, who carried compensation insurance with appellant, Employers Reinsurance Corporation.
