Defendants appeal as of right from an October 28, 1988, circuit court order that declared modified Civil Service Commission Rule 1-5.7 invalid, permanently enjoined defendants from enforcing it, and granted plaintiffs’ motion for summary disposition under MCR 2.116(0(10). In that same order, the circuit court denied defendants’ motion for summary disposition under MCR 2.116(C)(1), (5), and (8). We reverse and remand.
