This action arises out of a data breach (the “Security Breach”) involving Michael Stores Inc. (“Michaels” or “Defendant”), an arts and crafts retail chain. Plaintiff Mary Jane Whalen (“Whalen”), individually and on behalf of all others similarly situated, brings this class action against Defendant asserting claims for breach of implied contract and for violations of New York General-' Business Law (“GBL”) § 349.
