DAVIDSON, Presiding Judge.

Appellant was convicted of murder in the first degree, his punishment being assessed at life' imprisonment in the penitentiary.

He was charged with killing Professor J. G. Jacoway. Without going into a detailed statement of the facts, the record substantially shows that deceased was walking east on Graham Street in the city of Paris, with his young child in his arms, and about the time he arrived opposite the residence’ of Mr. Campbell appellant came around the corner of Campbell’s house carrying a pitcher of milk in one of his hands; that he saw deceased, who was…
