This appeal is from a conviction for murder in the second degree, the punishment assessed being a term of ninety-nine years’ imprisonment in the penitentiary. A motion for change of venue was made by defendant, which was overruled; but, the bill of exceptions to the ruling having failed to set forth the evidence adduced upon the motion, is not considered by the court, and is therefore elimiated from the case.

HURT, Presiding Judge.

Appellant was convicted of murder in the second degree and given 99 years in the penitentiary. Appellant filed a plea to the jurisdiction of the-court in effect alleging that the homicide occurred in Greer County, and that the courts of this State have no jurisdiction over offenses committed therein. Greer County has been recognized as an integral part of the State of Texas by general legislation of this State, and this court takes judicial cognizance that it is a part of this State, and the plea to the jurisdiction was properly overruled on this ground.
