This is an appeal from a judgment in the district court of Liberty County in favor of the appellee, First State Bank, and against the appellants, James A. Matthews and wife, Nannie Lou Matthews.

Appellants, Mr. and Mrs. Matthews, on March 14, 1955 were the owners of lot No. 16 of Treetop Terrace, a subdivision in Liberty County, Texas, near the City of Liberty. On that day they entered into a contract with L. D.
