This suit was brought by the plaintiff in error, Lee Pierson, in the district court of Cochran County to recover of S. B. Pierson the amount of a promissory note executed by the latter to the plaintiff in error, and to foreclose a mortgage executed by said S. B. Pierson and his wife to secure the payment of said note.
