Cesar L. Manganellis, defendant-appellant (“Manganellis”), was indicted on six counts of “knowingly and unlawfully distributing]” cocaine (between seven grams and one ounce for each count), in violation of 21 U.S.C. § 841(a)(1) (1982) (“section 841(a)(1)”). 1 Manganellis filed several pretrial motions, among them requesting the following: (1) severance of Counts II-VI from Count I, (2) a jury instruction regarding the credibility of a witness who is a cocaine addict, and (3) precluding the admission of extrinsic evidence concerning his alleged prior bad acts. 2 The…
