This action arises out of a labor dispute between defendant union and plaintiff, Lear Siegler, Incorporated. Plaintiff seeks a declaratory judgment under Title 28 U.S.C. §§ 2201, 2202, and under § 301 of the Labor Management Relations Act, as amended, Title 29 U.S.C. § 185. Plaintiff further seeks a temporary injunction against certain union conduct and seeks damages under § 303 of the Labor Management Relations Act, Title 29 U.S.C. § 187.

The basic facts are not disputed. This action is before the court following cross-motions for summary judgment by the parties.…
