The matter before the court is a petition for the appointment of a temporary guardian of Baby Boy W. with authority to make medical decisions for W pursuant to SCPA 1750-b. That section was just added to article 17-A by the Legislature, effective March 16, 2003 (L 2002, ch 500, § 3). W. was born on November 12, 2003 and so was about one month old when the petition was filed. The petitioner is the infant’s maternal grandmother as permitted by SCPA 1751.
