These three actions arose out of a collision which occurred 1:30 A. M., April 15, 1955 on Laskin Road, also known as Highway 164, Princess Anne County, Virginia, between a motor vehicle owned and operated by Elton L. Clark and a motor vehicle operated by Marty Kimnach in which her husband Charles Kimnach was a passenger.

Clark filed his motion for judgment on July 11, 1955 against Marty Kimnach and Charles Kimnach for personal injuries sustained. Marty Kimnach and Charles Kimnach filed their respective motions for judgment against Clark on August 22, 1955 for personal injuries. Over the…
