MEMORANDUM OF OPINION AND ORDER

NUGENT, District Judge.

This matter is before this Court on Defendant, Randy Shamblin’s, Motion to Dismiss (Doc. # 20) Plaintiffs’ amended complaint against him in his individual capacity pursuant to Fed.R.Civ.P. 12(b)(6). Plaintiffs have filed a Brief in Opposition to Defendant’s Motion (Doc. #23). For the reasons that follow, Defendant’s Motion to Dismiss (Doc. # 20) as it pertains to the issue of the individual liability of Plaintiffs supervisor, Randy Shamblin is GRANTED.
