This is an appeal by Hotel Casey Company from a decree of the Court of Common Pleas of Dauphin County quashing a petition for a writ of mandamus. After this court held, in Wellsboro Hotel Company’s Appeal, 336 Pa. 171, 7 A. 2d 334, that hotels operating dining rooms for the convenience of their guests were not subject to the payment of the restaurant mercantile license tax imposed by the Act of April 25, 1907, P. L. 117, sec. (72 PS §3131), the plaintiff applied to the Pennsylvania Board of Finance and Revenue for a refund of taxes paid in the years 1935 to 1939…
