Burd, Plaintiff in Error,

versus

Smith, Lessee of Fitzsimons et al.

Supreme Court of United States.

The cause was argued, in this Court, during the 12th, 13th, 14th, and 15th of January 1802, by Ingersoll, Lewis, and M`Kean, for the plaintiff in error; and by M. Levy, Rawle, and Dallas, for the defendants in error.

The Court, after taking time to deliberate, delivered opinions, seriatim, on the 20th of January 1802; of which the following is given as a general outline.
