dissent in a memorandum by Sullivan, J. P., as follows: Defendant was indicted for hindering prosecution in the first degree (Penal Law § 205.65) on November 2, 1988 and arraigned on November 4. On February 27, 1989, an Assistant District Attorney appeared and advised the court that the assistant to whom the case had been assigned was on trial and unavailable for at least another week.
