BACKGROUND

The Motion before the Court concerns numerous transactions involving computer and related equipment (“Equipment”) manufactured by International Business Machines, Inc. (“IBM”), owned by Atlantic Computer Systems, Inc. (“Atlantic” or “Debtor”), and leased to various third parties.
