JOHNSON, District Judge.
This is a civil action wherein the plaintiff, G. F. Heublein and Brother, a Connecticut corporation, seeks to restrain the defendants in their use of a trade-mark and for which use plaintiff also demands damages. The defendants are incorporated in the State of Delaware, having their principal place of business at Scranton, Lackawanna County, within the Middle District of Pennsylvania, so that jurisdiction rests upon diversity of citizenship. The amount of damages claimed by plaintiff is in excess of three thousand ($3,000) dollars, exclusive of interest and costs. The…
