The defendant in error, hereinafter called plaintiff, as administrator of the estate of Marcus Koch, deceased, sued the plaintiff in error, hereinafter called the defendant, in the Municipal Court for money had and received. On a trial before the court without a jury, there was a finding and judgment for the plaintiff for $226.75, and defendant has sued ont this writ of error.
Marcus Koch died at two o’clock a. m. on October 30, 1909. Ten days before his death, he gave the defendant, his attending physician, a check on a bank in Matteson, Illinois, for $392.50, which exhausted all of his bank…
