This cause originated in the Probate Court of Jackson County. On appeal to the circuit court of that county the judgment of the probate court was affirmed, and the case is here on appeal.
The record shows that on April 23, 1930, during the February Term, 1930, in the Probate Court of Jackson. County, an instrument of writing purporting to be the last will and testament of Jennette Toohey, deceased, was duly probated as such.
