A grand jury of this Court, in the course of investigating a company subject to the jurisdiction of the federal Food and Drug Administration (FDA), has asked that company to produce to that grand jury certain documents which relate to audits of the company’s operations by an outside consultant. The company, refusing so to do, has claimed a “self-evaluative” or “self-critical analysis” privilege with regard to the documents in question.
